1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "You") and Alex Grajdeanu ("Developer", "We", "Us") regarding your use of the PrecisionRush mobile game ("Game", "App", "Service").

By accessing or using PrecisionRush, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Game.

2. Description of Service

PrecisionRush is a skill-based timing game available on iOS devices through the Apple App Store. The Game offers:

• Multiple Game Modes: Arcade, Zen Practice, Multiverse, Daily Challenge, and Battle Mode
• Progression System: Level-based advancement, seasonal tiers, achievements, and daily missions
• Cosmetic Customization: Stopwatch themes, particle effects, and profile frames (earned through gameplay)
• Leaderboards: Global and weekly rankings via Apple Game Center (optional)
• In-Game Currency: Coins earned through gameplay to purchase cosmetics and power-ups
• Optional Support: One-time donations to support ongoing development (no gameplay impact)

3. Free-to-Play Model

PrecisionRush is a free-to-play game with the following characteristics:

• No Paywalls: All game modes, features, and content are accessible without payment
• No Pay-to-Win: In-game currency (coins) cannot be purchased with real money
• Cosmetics Only: All cosmetic items are earned through gameplay using coins
• No Advertisements: The Game does not display third-party advertisements
• No Forced Purchases: You are never required to make a purchase to continue playing

3.1 Support the Developer (Optional Donations)

The Game includes an optional "Support the Developer" feature that allows users to make voluntary one-time donations to support ongoing development. These donations:

• Are completely optional and not required for any gameplay feature
• Do NOT provide any gameplay advantages, bonuses, or exclusive content
• Do NOT unlock features, cosmetics, or remove restrictions
• Are processed through Apple's secure in-app purchase system
• Are non-refundable (subject to Apple's refund policy)
• Record only the transaction date locally for display purposes

4. User Responsibilities and Conduct

By using PrecisionRush, you agree to:

• Comply with Laws: Obey all applicable local, state, national, and international laws and regulations
• Use Legitimately: Play the Game fairly without using cheats, hacks, exploits, or unauthorized third-party software
• Respect Others: Not engage in harassment, bullying, or abusive behavior (if interacting via Game Center)
• Age Requirements: Be at least 4 years of age (or the minimum age required by your jurisdiction). Users under 13 should have parental consent.
• Account Security: Keep your device secure and not share access to your Game Center account

4.1 Prohibited Uses

You agree NOT to:

• Reverse engineer, decompile, disassemble, or modify the Game or its code
• Use bots, automation, scripts, or macros to play the Game
• Exploit bugs, glitches, or unintended game mechanics for unfair advantage
• Attempt to manipulate leaderboards or rankings through fraudulent means
• Use the Game for any illegal, harmful, or fraudulent purpose
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Impersonate others or misrepresent your affiliation with any person or entity
• Distribute or make the Game available over a network where it could be used by multiple devices simultaneously

5. Intellectual Property Rights

All content, features, and functionality of PrecisionRush, including but not limited to:

• Game design, mechanics, and code
• Graphics, images, animations, and visual effects
• Sound effects, music, and audio
• Text, dialogue, and written content
• Logos, trademarks, and branding

...are owned exclusively by the Developer and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

5.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Game on your iOS device(s)
• Use the Game for personal, non-commercial entertainment purposes

This license does NOT allow you to:

• Copy, modify, distribute, sell, or lease any part of the Game
• Create derivative works based on the Game
• Use the Game for commercial purposes

6. User-Generated Content

PrecisionRush does not currently support user-generated content (such as custom levels, avatars, or messages). All game content is created and provided by the Developer.

If you submit feedback, suggestions, or ideas about the Game (e.g., via email or reviews), you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation or attribution.

7. Data and Privacy

Your use of PrecisionRush is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Game, you consent to our data practices as described in the Privacy Policy.

Key points:

• Game progress is stored locally on your device
• Analytics are optional and can be disabled in settings
• We do not sell your data to third parties
• Game Center integration is optional

8. In-App Purchases and Payments

8.1 Payment Processing

All donations through the "Support the Developer" feature are processed through Apple's in-app purchase system. Apple handles all payment processing, billing, and transaction security. We do not store or process your payment information.

8.2 Non-Refundable Purchases

All donations are final and non-refundable except as required by applicable law or Apple's refund policy. Since donations provide no in-game benefit, they are considered completed upon successful transaction.

If you believe a charge was made in error, you may request a refund directly from Apple within the timeframe specified by Apple's policies. We cannot process refunds directly.

8.3 Pricing and Availability

Donation tiers and pricing are subject to change at any time without notice. Prices may vary by region due to currency conversion and local taxes.

9. Game Modifications and Updates

We reserve the right to:

• Modify, update, or discontinue any aspect of the Game at any time
• Change game mechanics, features, balance, or content
• Add or remove game modes, cosmetics, or progression systems
• Adjust in-game economy (coin rewards, costs, XP requirements)
• Reset leaderboards, seasonal tiers, or mission progress

We will make reasonable efforts to notify users of significant changes through in-app announcements or update notes.

10. Account Suspension and Termination

10.1 Our Right to Terminate

We reserve the right to suspend or terminate your access to PrecisionRush, in whole or in part, at our sole discretion, without notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Service
• Use of cheats, hacks, or unauthorized software
• Manipulation of leaderboards or game systems
• Abusive, harassing, or inappropriate behavior
• Fraudulent activity related to in-app purchases

10.2 Effects of Termination

Upon termination:

• Your right to use the Game immediately ceases
• You must delete the Game from your device(s)
• We may delete your local game data and progress
• Your leaderboard scores may be removed
• We are not liable for any loss of progress, purchases, or virtual items

10.3 Your Right to Terminate

You may stop using the Game at any time by uninstalling it from your device. To delete all associated data, you can:

• Use the in-game data reset option
• Delete the app and its data through iOS Settings
• Sign out of Game Center to remove leaderboard associations

11. Third-Party Services and Links

PrecisionRush integrates with third-party services:

• Apple Game Center: For leaderboards and achievements
• Firebase Analytics (Google): For optional analytics (can be disabled)
• Apple StoreKit: For in-app purchase processing

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or terms of third-party services.

12. Disclaimer of Warranties

PrecisionRush is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Game will be uninterrupted, error-free, secure, or virus-free
• That defects will be corrected or that servers are free of harmful components
• The accuracy, reliability, or completeness of any content or information

Your use of the Game is at your own risk. We do not warrant that the Game will meet your expectations or be compatible with all devices.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of or damage to property
• Personal injury or emotional distress

...arising from or related to your use or inability to use the Game, even if we have been advised of the possibility of such damages.

Maximum Liability: In jurisdictions that do not allow the exclusion or limitation of liability, our total liability to you for all claims arising from or related to the Game shall not exceed the amount you paid to us in the 12 months preceding the claim (if any).

14. Indemnification

You agree to indemnify, defend, and hold harmless the Developer, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Game
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

15.2 Jurisdiction

You agree that any legal action or proceeding arising from or related to these Terms or your use of the Game shall be brought exclusively in the courts of Romania, and you consent to the personal jurisdiction of such courts.

15.3 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at grajdeanu.alex@gmail.com. We will attempt to resolve the dispute through good faith negotiations.

16. Apple-Specific Terms

As PrecisionRush is distributed through the Apple App Store, the following terms apply:

16.1 Acknowledgment

You acknowledge that these Terms are between you and the Developer only, not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Game and its content.

16.2 Scope of License

The license granted to you is limited to a non-transferable license to use the Game on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple App Store Terms of Service.

16.3 Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for the Game. Apple has no obligation whatsoever to furnish any maintenance or support services.

16.4 Warranty

Apple is not responsible for addressing any claims you have or any claims of any third party relating to the Game or your possession and use of the Game, including but not limited to product liability claims, consumer protection claims, and intellectual property infringement claims.

16.5 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the Game and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or internet service provider failures.

18. Changes to Terms of Service

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by:

• Posting a notice in the Game
• Updating the "Last Updated" date at the top of this page
• Requiring you to accept the new Terms before continuing to use the Game (for significant changes)

Your continued use of the Game after changes are posted constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Game.
